This End User License Agreement ("EULA") is a legal agreement between you ("User") and APEX Training ("Licensor") for the use of the APEX: CrossFit & HYROX Training mobile application ("App"). This EULA supplements Apple's Standard Licensed Application End User License Agreement ("Standard EULA").
By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download or use the App.
Subject to your compliance with this EULA and payment of applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service.
This license does not allow you to:
The App operates on a subscription model. Access to training plans, workout tracking, and community features requires an active paid subscription. Subscription management (including cancellation and renewal) is handled through your Apple ID account. See our Terms of Service for full subscription details.
The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. Always consult a qualified healthcare professional before starting any exercise program. You use the App and follow its training plans at your own risk.
The App, including all code, design, training content, exercise databases, branding, and related intellectual property, remains the sole property of APEX Training. This EULA does not transfer any ownership rights to you. All rights not expressly granted herein are reserved.
The App collects personal and training data as described in our Privacy Policy. By using the App, you consent to such data collection and processing.
The App integrates with third-party services (Firebase, Anthropic Claude AI, RevenueCat, Apple services). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.
We may release updates to the App from time to time. Updates may be required for continued use. Some updates may modify or remove features. By using the App, you consent to such updates.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX TRAINING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
This EULA is between you and APEX Training only, not with Apple. Apple has no obligation to provide maintenance, support, or warranty for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for any third-party claims that the App infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
This EULA is governed by the laws of Spain, without regard to conflict of law principles. Disputes shall be resolved in the courts of Barcelona, Spain, except where mandatory consumer protection laws of your jurisdiction require otherwise.
